Acceptable Use policy

All services provided by TelNex™ Technologies, may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any or United States Federal, State or City, or any International laws is prohibited. This includes, but is not limited to: copy righted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless TelNex™ Technologies, from any claims resulting from the use of the service which damages the subscriber or any other party.

The following are unacceptable uses:

Illegality

in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, violation of U.S. export restrictions, harassment, fraud, trafficking in obscene material, drug dealing, and other illegal activities. Websites promoting illegal activities, including, but not limited to, hacking, serial numbers, cracks, or information which violates any local, state, federal, or U.S. export restriction laws. Websites which promoting Hate propaganda or have illegal Adult Material such as c h i l d p o r n are strictly prohibited. Because of increased controversy surrounding Emulators/ROMs, we do not allow any websites pertaining to Emulators/ROMs. These issues usually have to do with copyright violations and we prohibit any websites distributing Emulators or ROMs. Websites whose primary purpose is file distribution or mirroring another website. Illegal MP3 files are strictly forbidden from our servers. There are no exceptions made to this rule as it exists to protect ourselves from any copyright infringement problems.

Net abuse

including but not limited to activities such as using a non-existent e-mail return address on a commercial solicitation, spamming (sending unsolicited advertising to numerous e-mail addresses or newsgroups and/or generating a significantly higher volume of outgoing e-mail than a normal user), allowing spamming by third parties to promote a web site hosted by TelNex™ Technologies, Spam is a direct violation and will get the site deleted without notice or refund, trolling (posting outrageous messages to generate numerous responses), mail bombing (sending multiple messages without significant new content to the same user), subscribing someone else to a mailing list without that person's permission, cross-posting articles to an excessive number of newsgroups, or attempting without authorization to enter into a secured computer system. TelNex™ Technologies reserves the right to determine what constitutes net abuse. Any processes executed which run in the background from the command line, including IRC Bots, EXE's and CGI scripts. Links to illegal adult websites, illegal MP3 sites, warez sites, or hacking websites.

Tortuous conduct

including but not limited to posting of defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights.

Security

Violations of system or network security are prohibited and may result in criminal and civil liability. Examples include but are not limited to the following: unauthorized access, command line abuse, use, probing, or scanning of systems security or authentication measures, data, or traffic; interference with service to any user, host, or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system, broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting. Any attempts to undermine or cause harm to a TelNex™ Technologies servers, network or customers are strictly prohibited.

Copyright Material

Materials distributed on your website cannot infringe upon other groups copyrights. This especially includes distributing copyright software, illegal MP3 files which usually consist of copyrighted music, and Emulators/ROMs. Please ensure that your website consists of your own work and none of the contents on your website do not infringe upon anyone else's copyrights.

Actions Taken by TelNex™ Technologies

The failure by a customer to meet or follow any of the above Terms of Use may result in account termination. TelNex™ Technologies will be the sole arbiter as to what constitutes a violation of the Terms of Use. TelNex™ Technologies reserves the right to terminate any account without prior notice.
When TelNex™ Technologies becomes aware of an alleged violation of its Terms of Use, TelNex™ Technologies will initiate an investigation. During the investigation, TelNex™ Technologies may restrict a customer's access in order to prevent further potentially unauthorized activity. Depending on the severity of the violation, TelNex™ Technologies may, at its sole discretion, restrict, suspend, or terminate a customer's web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, TelNex™ Technologies will notify the appropriate law enforcement authorities of such violation. TelNex™ Technologies does not issue credits for outages incurred through service disablement resulting from Terms of Use violations.

TelNex™ Technologies reserves the right to change, modify, or update this statement at any time without notice.
